PRIORITY SUP SURF – TERMS AND CONDITIONS

All bookings, rentals, lessons, packages, and related services are subject to the following Terms & Conditions. These Terms constitute a legally binding agreement between you and Priority SUP Surf (legally operating as CV Jaya Laut Nusantara).

By booking, paying, participating, or renting equipment, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.

1. DEFINITIONS

  • “Company” refers to Priority SUP Surf / CV Jaya Laut Nusantara, its owners, directors, employees, instructors, agents, contractors, affiliates, and representatives.
  • “Participant” refers to any individual taking part in lessons, rentals, transfers, or related services.
  • “Party Leader” refers to the person making the booking on behalf of others.
  • “Services” include lessons, rentals, transfers, packages, events, and any related activity.
  • “Force Majeure” refers to any event beyond the reasonable control of the Company.

2. CONTRACT FORMATION

A binding contract is formed once:

  1. Full or partial payment is received; and
  2. A Booking Confirmation is issued.

The Party Leader confirms authority to bind all participants in their group to these Terms & Conditions. Failure to read these Terms does not release you from compliance.

3. ASSUMPTION OF RISK

Stand Up Paddleboarding (SUP), surfing, and water activities involve inherent risks, including but not limited to:

  • Drowning.
  • Strong currents, tides, rips, and shore breaks.
  • Collisions with boards, fins, reefs, marine life, or vessels.
  • Sudden weather changes.
  • Physical exhaustion.
  • Equipment malfunction.

By participating, you:

  • Voluntarily assume all risks, known and unknown.
  • Accept full personal responsibility for injury, loss, or death.
  • Acknowledge that participation is entirely at your own risk.

4. WAIVER & LIMITATION OF LIABILITY

To the fullest extent permitted under applicable law:

  • The Company shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages.
  • The Company shall not be liable for personal injury, death, property damage, or financial loss unless directly caused by proven gross negligence of the Company.
  • Liability, where legally imposed, shall be strictly limited to the total amount paid for the specific service booked. You waive any claim exceeding this amount.

The Company is not liable for: acts of other participants, third-party providers, natural hazards, environmental conditions, government restrictions, traffic delays, beach conditions, or marine debris.

4.1 No Insurance Provided: Priority SUP Surf (CV Jaya Laut Nusantara) provides NO insurance coverage of any kind (medical, personal accident, or property) for any activities, lessons, or rentals. 

4.2 Participant Responsibility: The Company strongly advises and expects all participants to have their own comprehensive travel and medical insurance policy that specifically covers “high-risk” or “extreme” water sports. 

4.3 Injury: The Company is not responsible for any injury, illness, or death sustained during or after the services provided. You participate entirely at your own risk.

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Priority SUP Surf (CV Jaya Laut Nusantara) from:

  • Any claims arising from your participation.
  • Any claims arising from your negligence, willful misconduct, or failure to follow instructions.
  • Any damage to equipment or third-party property.
  • Any claim brought by a member of your party.

This indemnification survives the termination of services.

6. PAYMENT POLICY

  • Full payment is required to confirm a booking. No registration is complete without payment.
  • All payments are non-transferable unless approved in writing.
  • Transaction fees are non-refundable.
  • Currency exchange differences and bank fees are borne entirely by the customer.

7. PRICES

  • Prices may change without notice.
  • Confirmed and fully paid bookings are generally price-protected.
  • Promotional rates are non-retroactive and cannot be applied to existing bookings.

8. ALTERATIONS

  • Requests for alterations must be made in writing.
  • Changes are subject to availability and administrative fees may apply.
  • A reduction in participant numbers does not guarantee a price reduction.
  • The Company reserves the right to change instructors, timing, location, or format if required for safety or operational reasons.

9. ARRIVAL & PUNCTUALITY

  • Participants must arrive 15 minutes prior to the lesson start time.
  • Late arrival may result in cancellation without refund.
  • Group lessons will start at the scheduled time; no extra time will be added for late arrivals.

10. TERMINATION

The Company may terminate services immediately, without refund, if a participant:

  • Fails to follow safety instructions.
  • Is under the influence of alcohol or drugs.
  • Engages in dangerous or abusive behavior.
  • Causes a disturbance or damages property.

11. CANCELLATION & REFUND POLICY

A strict cancellation policy applies to all bookings:

  • More than 24 hours notice: 50% refund.
  • Less than 24 hours notice: No refund.

No refunds will be issued for: Early withdrawal, injury during a lesson, weather conditions (unless the Company cancels), missed transfers, no-shows, or a change of mind. Refunds are at the Company’s sole discretion. Vouchers or rescheduling may be offered in lieu of refunds.

12. FORCE MAJEURE

The Company is not liable for cancellation, delay, or modification caused by natural disasters, severe weather, war, terrorism, government restrictions, civil unrest, public health emergencies, road closures, religious ceremonies, or any event beyond reasonable control. No compensation or refunds are payable under Force Majeure.

13. TRANSFER SERVICE (If Applicable)

  • Operates on a first-come, first-served basis.
  • Maximum wait time is 5 minutes. A missed shuttle results in no refund.
  • Traffic conditions may alter pickup times.
  • Available only for designated areas and not applicable for bookings made under 24 hours in advance.

14. GROUP LESSON CONDITIONS

  • Minimum age: 15 years.
  • Specific language requests are not guaranteed.
  • Instructor decisions regarding safety and lesson execution are final.

15. BOARD & EQUIPMENT RENTAL TERMS

15.1 General: Prior surf/SUP experience is required for independent rentals. Minimum age is 15. A valid ID and deposit are required. An Equipment Rental Agreement must be signed prior to taking the equipment. 15.2 No Insurance: Priority SUP Surf provides NO insurance coverage for the equipment, the renter, or third-party damages. You rent entirely at your own risk. 15.3 Full Financial Responsibility: You are fully liable for loss, theft, damage, third-party injury, and environmental damage. Payment obligations are as follows:

  • Lost/Stolen board: Full retail replacement value.
  • Major damage: Up to 100% of retail value.
  • Minor damage: Repair cost plus labor.
  • Broken accessories (leashes, fins, paddles): Up to 100% retail replacement value.

Damage assessment is determined solely by the Company. No disputes will delay your payment obligation. There are no refunds for early return of rental equipment.

16. EQUIPMENT CARE

Participants must:

  • Avoid dragging equipment on sand, concrete, or rocks.
  • Store boards in the shade, away from direct heat/sun when not in the water.
  • Rinse equipment with fresh water after use.
  • Wear the provided leash at all times in the water.
  • Avoid contact with reefs and shallow rocks.

Negligence in equipment care will increase your financial liability.

17. PHOTO & VIDEO RELEASE

You grant the Company perpetual, worldwide, royalty-free rights to use your image, video recordings, and likeness in marketing and promotional materials across all media platforms. Opt-outs must be requested in writing prior to participation.

18. HEALTH DECLARATION

Participants confirm that they:

  • Are physically fit and within the required age limits (7–65 for general activities, 15+ for group/rentals).
  • Have disclosed all relevant medical conditions (e.g., asthma, heart conditions, epilepsy).
  • Are not under the influence of drugs or alcohol.
  • Can swim independently (unless explicitly stated otherwise for specific guided flat-water tours).

Failure to disclose relevant medical conditions voids any liability of the Company. The Company reserves the right to refuse participation for safety or health reasons.

19. MEDICAL TREATMENT CONSENT & INSURANCE

In the event of an emergency, you authorize the Company to arrange emergency medical treatment, evacuation, or hospital transfer. All resulting medical and transport costs are entirely your responsibility. The Company strongly recommends that all international participants carry comprehensive travel and medical insurance that covers extreme water sports.

20. PERSONAL PROPERTY

The Company is not responsible for lost, stolen, or damaged personal items or valuables. Participants are strongly advised not to bring valuables to the beach or leave them in transport vehicles.

21. WEATHER & ENVIRONMENTAL CONDITIONS

Ocean conditions are inherently unpredictable. Beach cleanliness, water quality, and seasonal marine debris are not controlled by the Company. No refunds will be provided due to environmental conditions unless it poses a severe safety threat and the Company initiates the cancellation.

22. DATA PROTECTION & PRIVACY

The Company collects personal data (name, contact details, health declarations) solely for the purpose of processing bookings, ensuring safety, and meeting legal obligations. Your data will not be sold to third parties and will be stored securely in accordance with applicable international data protection standards.

23. NO RELIANCE CLAUSE

Participants acknowledge they have not relied on any verbal statements or promises not expressly contained in this agreement. Promotional materials and photos are illustrative only.

24. SEVERABILITY

If any provision of this agreement is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and the remainder of the agreement shall remain fully valid and enforceable.

25. GOVERNING LAW & DISPUTE RESOLUTION

This agreement shall be governed by and construed in accordance with the laws of the Republic of Indonesia. In the event of a dispute, both parties agree to attempt amicable resolution through mediation first. If unresolved, disputes shall be submitted exclusively to the competent courts of Bali, Indonesia. The Company reserves the right to seek full recovery of legal fees and court costs.

26. ENTIRE AGREEMENT & ACCEPTANCE

These Terms & Conditions constitute the entire agreement between the parties and supersede all prior communications, drafts, or representations.

By booking, paying, renting, or participating in any activity with Priority SUP Surf, you formally confirm that:

  • You have read, understood, and voluntarily agree to these Terms.
  • You accept all associated risks and liabilities.
